When you hear the word "Income" do you think it means "Earnings"? Afterall, when you earn money from work it's "Income"; Right?… Maybe not. "Income", defined, is: "gain derived from capital…labor…or both…including profit…through sale or conversion of capital. Income is not a gain accruing to capital or growth in…investment, but is a gain, a profit …severed from the capital…" (Black's Law Dictionary, Sixth Edition). The keyword in the definition is "GAIN". In 1920 the U.S. Supreme Court Justices expressed their Opinion on the definition of "Income" when they Opined: "The Government,…placed chief emphasis upon the word 'gain'…while the significance of the next three words was either overlooked or misconceived-'derived from capital'…Here we have the essential matter…" [Eisnerv.Macomber, 252 US 189, 207 (1920)]. The Justices in the Eisner case were saying "Income is gain"; not an exchange. When employees trade labor (i.e., personal property) for money (personal property), there's no "GAIN". It's trading a bushel of wheat for a barrel of apples; AN EVEN EXCHANGE! The idea, trading labor for money represents "GAIN", places greater value on "money" than "labor". |

In fact, it is referred to as a “voluntary” tax. How can this be? Well, simple. When you fill out a W-4 form, you are essentially signing yourself into servitude and “volunteering” yourself to pay the tax. |
